LCP Medical Respirator Disclaimer

LCP Medical is seeking medical use certification by the U.S. Food and Drug Administration (FDA) and the National Institute of Occupational Safety and Health (NIOSH) for its PathoGen1™ Optically Clear Respirator.

Respirators, such as filtering facepiece respirators and other respirator types, are designed to help reduce users’ inhalation exposure to particulate hazards when used correctly. It is the Buyer’s responsibility to review LCP Medical’s instructions for use and use the respirator properly.

It is critical before each use that the respirator is inspected for damage or missing parts. The respirator should be disposed of immediately upon observations of damage.

It is critical before each use to confirm the respirator is not missing its filter, and that the filter is being replaced on a regular basis per LCP Medical’s instructions for use. Filters for the respirator have a limited use life as set forth in LCP Medical’s instructions for use. When filters are maintained outside of LCP Medical’s instructions for use, LCP Medical cannot ensure that the respirator will meet performance requirements.

It is critical that before use a seal check of the respirator is conducted by the user per LCP Medical’s instructions for use. It is very important that your respirator be able to seal completely to your face. If a respirator does not seal well to your face, airborne hazards can enter through gaps in the face seal. If the person using the respirator cannot achieve a proper seal the respirator should not be used.

No matter how well a respirator seals to the face and how efficient the filter media is, users should expect a small amount of leakage inside any respirators. No respirator will eliminate exposure entirely.

To help protect the condition of respirators so they can function correctly, it is important to store them according to the specified storage requirements. The PathoGen1™ should be stored in the original packaging and away from contaminated areas, sunlight, extreme temperatures, excessive moisture and damaging chemicals. When respirators are maintained outside of the established storage conditions, LCP Medical cannot ensure that the respirators will meet performance requirements.

Limitation of Damages: Under no circumstances will LCP Medical be liable for lost profits or any other incidental or consequential damages notwithstanding the fact that LCP Medical has been advised of the possibility of such damages. No agreement varying or extending the foregoing warranties, remedies or limitations will be binding upon LCP Medical unless in writing and signed by a duly authorized representative of LCP Medical. User agrees that LCP Medical will not be liable for any special, indirect, or consequential damages, lost profits, or for any claim or demand against User by any other party.

LCP Medical Face Mask Disclaimer

The LCP Medical FrontLine™ and EasyBreathe™ Masks are non-medical masks designed for everyday reusable wear intended for use by the general public. LCP Medical is not seeking medical use certification by the U.S. Food and Drug Administration (FDA) and the National Institute of Occupational Safety and Health (NIOSH) for its face masks. Pending NIOSH, Occupational Safety and Health Administration (OSHA), American Society for Testing and Materials (ASTM) standards recommendations for fabric based consumer face masks will be accommodated and certified for the FrontLine™ and EasyBreathe™ Masks as appropriate per issued guidelines.
